Flat registry possible only after multistory full development according to High Court Decision 

A builder had encroached 10 feet of road area in the multistory building in Sikar. The Government has to take action upon it.

High court has given orders to the builders to not go forward with registry of uncompleted multistory buildings. Also, they would have to show a certificate of completion of the building. Also, this would curb the unfair and illegal encroachments that have been happening amongst the builders. The high court has given orders to the deputy registrar to send this order copy to the ACS UDH. This final order was put forward after the appeal of Mr. Chirnajilal Pilania of Sikar.


The high court has also put forward a suggestion for people planning to buy property in any multistory building that they should that the map and blueprint of the developing building has been passed by the concerned authorities. This will help create awareness amongst public, as it is not possible for the government to stop all illegal constructions at a point of time.

Rajasthan High Court has given an order to the Sikar Parishad that they should take compound related decision in the illegal property matter in Sikar. If the builder is suffering from the order then he can appeal at DLB and the DLB needs to give a decision in 15 days. If the decision comes against the builder then the court needs to take action against the builder and send notifications o the builder and the flat owners and demolish the building as applicable. If the flat owners are suffering then they can put forward their view in the appeal.

This was the case –

According to Anoop Dhand, Dev developers of Sikar had taken g+3 permission from Sikar Parishad on the land bought by them. But the developer encroached the pathway too and built g+4 on the premises. The neighbor put his application against the builder at state government, jila collector and Nagar Parishad offices.

Parishad agreed that the development was illegal and gave notice to the builder to demolish it. But the building was not sealed. The developer took advantage of the situation and started selling the flats in the building. This matter was again sent to high court. The high court asked the report from Jila collector. Then it came forward in the picture that the developer even encroached the ten feet road area in the building premises. He didn’t even leave setback and built G+4 instead of G+3.

After certain alterations, the Jaipur Development Authority (JDA) has finally given green signal for the elevated road between Ambedkar Circle and Sodala Tri-junction, near the existing Bais-Godam Railway over-bridge (ROB). 

The project was in limbo for the last two years owing to poor feasibility.

Water issue between JDA and PHED

PHED – JDA should announce its priorities

JDA – First water should be supplied in buildings.

The government system of water supply seems dice and unable to reach the water needs of various multistory buildings. It seems this problem will not be solved until summers of 2016. Even after tug of word war between JDA and PHED for two months no solution has come to stand. According to PHED, only after declaration of priorities by JDA, DPR can be formed. On other hand JDA puts its issue forward that, they have already explained their trend by multistory high rise buildings, now they cannot foretell their plans of a decade as to how many and how son such projects will be made in future. 

Water should reach the old projects -

According to JDC, Shikhar Agarwal, PHED wants to know their future projects. However, this cannot be forecasted as of now. JDA has already clarified the trend set of various multistory building projects that have come up in past decade. PHED should first make water available in all those projects.

Structural cost Rs. 385 sq meters-

Bapu Nagar, Civil Lines, Tilak Nagar and Bani Park was declared multistory zone by PHED. The project based on Delhi water board and Malviya nagar self-finance scheme amounted to structural cost of Rs.385 per square meters on a 10 square km, four multi storied zones.

Water will be available in all multi-storied buildings only after 2017-

The capacity of Bisalpur Dam (surajpura) to Balawala pipeline is 5600 lakh liters only. At present, the city is getting 3950-lakh liters water supply by Bisalpur pipeline. After making a new treatment plant of 2000 lakh liters, another 10 square kms area including Jagatpura, Kho Nagorian, Jamdoli and Prithviraj Nagar would be able to get the water supply. The multistory buildings will only be able to get the water supply by 2017 when the second phase of project of 4000 lakh liters is completed.

PPP Mode Projects in Slow mode

The work status of the upcoming 20,000 kms road stretch is yet to commence.

The central government has rejected three proposals under VGF or road viability gap funding of PPP project. This has caused concerns for the authorities. Though PWD officials will submit new proposals for the same. In addition, a meeting is to take place on this matter between central and state authorities. VGF gets 20% support from central government and another 20% from state government and rest comes from investors. If any financial gap is created in this set up then the investor gets benefit of certain circumstances and monetary help from state government. PPP cell in PWD department for road development works was formed in September 2014. Earlier this bill was presented in parliament on 1st August 2014. However, the governor signed and gave it a green flag on May 2015.

If the circumstances remain same then only 20% work would be accomplished in the next four years.


The work order, criteria for selection for work etc has stretched to a year in the PPP project and the actual work has not yet started. If the present circumstances do not alter then not even 20% of work would be completed in stipulated time.

Anticipated work/Actual work done- 


  1. 20,000 kms of road is to be completed.
  2. PWD divided the work in packages. In the first phase of 129 packages, 8910 kms of work is anticipated.
  3. Out of 129, only eight packages have come under VGF, rest is under annuity. (Annuity - when investor is granted financial support and then it is taken back in form of EMI’s from the investor.)
  4. Out of this also central government dismissed 3 phases of VGF, as they were not according to central government standards. 
  5. This resulted in no work commenced on any road.



The workflow rate is ok and the results will be soon visible according to PPP’s SE Mr. Shivlahri Sharma.

According to Mr. Sharma, the workflow is going as anticipated and soon the results will be visible. All the paperwork has been completed. Now the roadwork will be seen in full progress. Many challenges are also being faced like dismissal of three projects by central government. New agendas will be formed in the next meeting.

JDA will rent upcoming Achrol Golf Course for 60 years

PDKOR has submitted the project report to Rajasthan Government.

JDA will give the upcoming gold court at Achrol on rent for 60 years. PDKOR has already submitted the project report to the state government. The main points of project development and PPP (Private People Cooperation) have been highlighted in the report. The project is termed as Golf Court Elide. JDA will soon start the work order.

This project speed up on the onset of Resurgent Rajasthan 2015. This has also geared up the discussion process every few days by the JDA officers. JDC and concerned officers meeting was held on Friday. Discussions were held upon the PDKOR report in the meeting. PDKOR is the combined undertaking company of Rajasthan Government’s Infrastructure leasing and financial services. JDA has handed the work in progress undertaking to PDKOR for this project.
